Haya Rashed Al Khalifa wins a historic decision on financial derivatives with the largest monetary award in GCC history.
In a historic decision, Bahrain’s fifth supreme civil Appeals court upholds an order by the High Civil court for Maan Al Sanea to pay Awal Bank more than $ 750 million dollars.
The court has upheld a massive payout from a Saudi business man for the favour of Awal Bank.
The judgment of the Court of first instance has compelled the Saudi businessman Mr. Maan Abdul Wahed Al Sanea to pay up the following sums for the favour of the plaintiff (Awal Bank): i) Saudi Riyal 1,179,450,000 (ii) GBP £53,239,602 (iii) Kuwaiti Dinar 31,690,885 (iv) US$200.655.000 (v) US$19,215,301, and (vi) Saudi Riyal 193,436,037 (or its equivalent in Bahraini Dinars from the date of accrual quotient on 7/9/2009) and legal interest rate of 1% from the date of bringing the claim and until full settlement.
The payout has been described as “One of the largest monetary judgments ever awarded in the GCC”.
The ruling is a significant achievement for the bank’s administrators as the asset realisation stage of the administration continues. The administration of Awal Bank is part of one of the most complex global insolvency cases in corporate history.
Haya Rashed Al Khalifa Attorneys led by Principal Partner, Sheikha Haya Rashed Al Khalifa, acted as counsel for the Bank, stated that this case is considered as one of the largest financial dispute cases in the GCC history and the appeals court judgment will have positive implications for Bahrain and GCC economy. This is because the dispute is linked to other cases and the courts looking into them must by law adhere to this conclusive judgment.
في واحدة من أكبر القضايا الخليجية ، إن لم تكن هي الأكبر على الإطلاق ، حيث قضت محكمة الإستئناف العليا المدنية الخامسة بجلستها المنعقدة بتاريخ 22 ديسمبر 2016م بقبول الإستئناف شكلاً وفي الموضوع برفضه وبتأييد حكم أول درجة ، وكانت محكمة أول درجة قد حكمت بإلزام رجل الأعمال السعودي معن عبد الواحد الصانع بأن يؤدي إلى بنك أوال مبلغ وقدره -/1179450000 ريال سعودي (مليار ومائة وتسع وسبعون مليون وأربعمائة وخمسون ألف ريال سعودي) ومبلغ -/53239602 جنيه إسترليني (ثلاثة وخمسون مليون ومائتان وتسعة وثلاثون ألف وستمائة وإثنان جنيه إسترليني) ومبلغ -/31690885 دينار كويتي (واحد وثلاثون مليون وستمائة وتسعون ألف وثمانمائة وخمسة وثمانون دينار كويتي) ومبلغ -/200655000 دولار أمريكي (مائتي مليون وستمائة وخمسة وخمسون ألف دولار أمريكي) ومبلغ -/19215301 دولار أمريكي (تسعة عشر مليون ومائتان وخمسة عشر ألف وثلاثمائة وواحد دولار أمريكي) ومبلغ -/193436037 ريال سعودي (مائة وثلاثة وتسعون مليون وأربعمائة وستة وثلاثون ألف وسبعة وثلاثون ريال سعودي) أو ما يعادلها بالدينار البحريني من تاريخ الإستحقاق الحاصل في 7/9/2009م والفائدة القانونية 1% سنوياً من تاريخ رفع الدعوى وحتى السداد التام والرسوم والمصاريف المناسبة ومبلغ ثلاثون دينار أتعاب محاماة.
وقد مثل البنك في الدعوى مكتب المحامية الشيخة هيا بنت راشد آل خليفة التي صرحت بأن هذه القضية من القضايا الكبيرة التي من شأنها التأثير على الإقتصاد البحريني وكذلك الإقتصاد الخليجي نظراً لما سيترتب على هذا الحكم من آثار سواء كانت آثار قانونية أو آثار إقتصادية لتعلق النزاع بقضايا أخرى مرتبطة بها . حيث يتوجب قانوناً على المحاكم الأخرى الإلتزام بحجية هذا الحكم الذي أصبح حكماً نهائياً.
